Terms & Conditions

Unless otherwise expressly agreed in writing, your membership in frank (the “Company”) and participation in all of its events is subject to the following terms and conditions of service (“Terms”), which shall form an integral part of this agreement of service (this “Agreement”) between you (the “Client”) and the Company:

  1. Limitation of Liability: In no event shall the Company, its owner(s) (including but not limited to Dayna Lapkovsky), officer(s), director(s), shareholder(s), advisor(s), employee(s) or agent(s) be liable for any direct, indirect, special, incidental, consequential, punitive or other damages resulting from your membership or participation in the Company, its events or any other services provided by the Company or its affiliates. To the fullest extent possible under the law, you hereby agree to waive all remedies, warranties, guarantees or liabilities with regards to the Company or its affiliates. This limitation shall apply even if the Company, its owner(s), officer(s), director(s), shareholder(s), advisor(s), employee(s) or agent(s) were advised of the possible occurrence of the damages before they occurred. This limitation is an essential element of this Agreement.

  2. Code of Conduct: You acknowledge that each group will form its own rules and guidelines for its group sessions and otherwise (the “Code of Conduct”). You agree to adhere and comply with all of the Code of Conduct. You agree that the following rules will be included in your Code of Conduct:

    1. Respect: All group members will act in good faith, showing respect and integrity to other group members.

    2. Confidentiality: Nothing mentioned in the group can be discussed outside the group except with the specific member whose issue it is, assuming that no one from outside the group is present: “What is said in the group, stays in the group.” Notwithstanding the foregoing, no member shall be required to keep information confidential regarding illegal activity or information relating to physical harm that a member may cause to themselves or to others.

    3. Non-Solicitation: No member may solicit business from other members though a member may request services from a member. The solicitation of charitable contributions is permitted but no one should be forced to contribute.

    4. Member Participation Commitment: Each member of the group is responsible for her own group experience. It is up to each member to get most out of the group by fully participating and sharing experiences. Each member should seek to be the first to share and to be proactive when you have a problem.

  3. Assignment: The Client may not assign any of its rights or obligations under this Agreement without the prior written consent of the Company. The Client cannot send a replacement to attend the meetings. Membership fee payment is final and non-refundable. Should a member decide to leave the cohort, or miss sessions, the program fee is required to be paid in full.

  4. Acknowledgment: The Client acknowledges that she: (i) has had sufficient time to review this Agreement and (ii) has read and understands the Terms.

  5. Language: The Parties acknowledge that they have required that this document be drawn up in the English language. Les Parties reconnaissent avoir demandé que la présente entente soit rédigée en anglais.
